Please read these Terms of Service ("Terms") carefully before using the Vantage platform operated by Vantage Cost Analytics ("Vantage," "we," "us," or "our"). By accessing or using any Vantage application, you agree to be bound by these Terms.
Vantage provides professional cost estimating software delivered as a web-based service, including Vantage Software, Vantage Construction, Vantage IT, and Vantage Energy (collectively, the "Service"). The Service is provided via subscription on a monthly or annual basis, with a limited free tier available.
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering. You may not use the Service if you are under 16 years of age.
Each account may be used by one individual user (or, for Team/Enterprise plans, by the number of seats included in your plan). Sharing accounts or credentials between multiple individuals is not permitted on single-seat plans.
Free tier: A limited free tier is available with no credit card required. Free tier users have access to core estimating features with restrictions on custom elements, exports, and cloud saves.
Paid plans: Paid subscriptions are billed monthly or annually in advance. Prices are listed on each application's pricing page and are subject to change with 30 days' notice to existing subscribers.
Annual subscriptions: Annual plans are billed upfront for the full year at a 20% discount versus monthly billing. Annual plans are refundable on a pro-rata basis within 30 days of purchase; after 30 days, no refunds are issued for the remainder of the annual term.
Cancellation: You may cancel your subscription at any time from the billing portal within the application. Cancellation takes effect at the end of your current billing period; you retain access through that date.
Failed payments: If a payment fails, we will attempt to retry. If payment cannot be collected, your account will be downgraded to the free tier until payment is resolved.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all cost estimate data, project files, and other content you create or upload to the Service ("Your Data"). You grant Vantage a limited license to store, process, and display Your Data solely to provide the Service to you.
We will not share, sell, or use Your Data for any purpose other than providing the Service. See our Privacy Policy for full details.
You are responsible for the accuracy of Your Data and for ensuring that your use of the Service complies with applicable laws and regulations in your industry and jurisdiction.
The Service, including its software, design, methodology, parametric models, and documentation, is owned by Vantage Cost Analytics and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
Cost estimates and reports you generate using the Service are your work product. We claim no ownership over outputs you create using the Service.
The Vantage AI assistant is powered by Anthropic's Claude model. AI responses are provided for informational purposes only and should not be relied upon as professional cost estimating advice, engineering guidance, financial advice, or legal counsel. You are responsible for independently verifying all estimates and outputs before using them for any business, procurement, or financial purpose.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANTAGE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that cost estimates produced by the Service will be accurate. Cost estimating involves inherent uncertainty; the Service is a tool to assist professional judgment, not replace it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANTAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF VANTAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall Vantage's total liability to you exceed the amount you paid for the Service in the 12 months preceding the claim.
You agree to indemnify and hold harmless Vantage Cost Analytics and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to modify or discontinue the Service (or any feature) at any time with reasonable notice. We may update these Terms from time to time; material changes will be communicated by email or in-app notice. Continued use of the Service after changes constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.
